Wie schaut es bei Euch aus mit Informationen über den Werdegang?

Habt ihr auch die Nachricht heute bekommen mit dem neuen Angebot? Jetzt ist wenigstens auch mal der Name des Partners und die Firma Rising Sun genannt wurden.

Gerade die Mail gelesen! O_o wobei ich gerade etwas sehr überrascht bin...

Dear sir/madam,

I have been contacted by Mr. I.J. Looman with the request of assisting him in resolving his untenable financial situation.

In the past, client carried an enterprise – together with Mr. Kuperus - named Rising Sun Performance V.O.F. A combination of circumstances has forced the partners to cease the company. Partly due to an insurmountable debt, it was no longer justifiable to allow the company to exist any longer.

Over the past months, Mr. Looman has been working on repaying his company debt. In order to do so, Mr. Looman has reduced his monthly expenses to a minimum, and has sold possessions (including a Honda S2000). However, we must conclude that repayment of the total debt by Mr. Looman, regardless of the measures taken, is not a realistic possibility. The company debt is simply too extensive. Unfortunately, we must conclude that Mr. Looman will be unable to meet his payment obligations.

Since Mr. Looman would like to pay back as much of his debt as possible, which he can do if a situation in which the WSNP comes into play is prevented, Mr. Looman would like to make you a proposal for 22 percent of your claim (subject to financing by the stadsbank Arnhem). In the calculation of this percentage, the expected repayment capacity of Mr. Looman in the WNSP situation has been assumed. If all creditors accept the offer, a so-called extrajudicial agreement will be established. It is important for all creditors to agree with the proposal as well. By accepting the proposal, you waive the remainder of your claim on Mr. Looman. The benefits of the proposal for you are:

you will receive a larger portion of your claim, since the family of Mr. Looman has proven to be willing to provide money for the agreement,
you do not have to wait three years for the amount to be paid to you. The remainder of the amount in the agreement will be paid by the Stadsbank Arnhem. This means that, by accepting the proposal, you are not dependent on the income of Mr. Looman over the next three years. Also because enrollment into the WSNP increases the risk of Mr. Looman losing his current job, you can limit your risk by approving the offer.
the extrajudicial settlement will eliminate the need to hire an administrator. Since the salary of the administrator takes priority over all creditors, this agreement will result in a higher amount paid to you.
Given the current (financial) situation, I would like to ask you to let me know within 14 days after today, whether you are willing to cooperate in reaching an agreement. Without your approval, I have no other choice but to file a request for admission to the WNSP. Moreover, for the record, I would like to point out that this agreement, or payments resulting from that, are completely separate from any offer and / or payment by or on behalf of Mr. Kuperus Your claim on Mr. Kuperus shall therefore remain undiminished.

Ja genau, hätte damit überhaubt nicht mehr gerechnet das was von Looman seiner Seite noch was kommt.
Hab auch direkt eben angerufen da in der Kanzlei, also das ist dann so wie ich das aus der Mail herraus und am Telefon verstanden habe, ist es das gleiche wie beim Herr Kuperus. Demnach müssen alle zustimmen innerhalb der nächsten 2 Wochen, und das Geld würde wohl jedem danach ausgezahlt werden "22 Prozent" des gezahlten geldes.

Beim Herr Kuperus waren das ja nur 9 Prozent!

Wenn ich was falsches geschrieben habe, bitte verbessert mich!

Also ich werde dem ganzem zu stimmen weil für mich steht da immer noch eine ganze Menge Geld auf dem Spiel! und bin froh wenn ich da überhaubt noch was wieder bekomme.

Sind es dann 22% von Looman und 9% von Kuperus oder insgesamt 22%? Ich habe keine solche Mail erhalten.

Das ist eine sehr gute Frage, kann ich dir leider momentan auch noch nicht sagen, denke aber das es getrennt von einander ist.
Bei Kuperus läuft das ganze ja über einen richtigen Insolvenz Verwalter und bei Looman war das Schreiben jetzt von einer Anwalt Kanzlei weiß nun nicht ob man da unterschiede machen kann? bzw gibt?
